E. Use of Copyrighted Material

1. Workforce Members must comply with all laws pertaining to copyright protection.

2. Workforce Members are prohibited from using copyrighted material not owned by or licensed to Banner on any Corporate-Owned Business Tools, networks, or Media Devices.

3. Workforce Members must not use the copyrighted material beyond the scope of the license.

4. Unlicensed copyrighted material on Banner’s Business Tools, networks, and Media Devices will be removed, without notice, by Banner.

What do BHLS Staff do?

  • Library Staff adhere to the Copyright Law of the United States and Related Laws Contained in Title 17 of the United States Code 
  • Follow the "Rule of Two" - As outlined in Section 108 of Title 17 of the US Code, our library service may provide one article, per issue, per patron without requesting copyright permission; when the "one article" per "issue" per "patron" is exceeded then we must request copyright permission and pay any applicable royalty fees for the second and subsequent copies. Only applicable where we DO NOT have an existing subscription/license. This cost is NOT passed on to the customer/requestor.
  • Follow the "Suggestion of Five" - The CONTU guidelines provide guidance for libraries in regards to Section 108, Title 17 of the US Code. Borrowing libraries may receive copies of up to five articles from a single periodical title (as opposed to a single issue) per calendar year. Starting with the sixth copy, copyright permission and royalty fees may be required and you must evaluate whether the copies requested would substitute for a subscription to, or purchase of, the journal. We keep records that will tell us when any of these suggested/recommended limits are exceeded. Either once per quarter or twice per year, library staff will generate invoice to pay royalties to content used that wasn't licensed and exceeded aggregate limits. This payment is sent to Copyright Clearance Center who then pays the royalty dividends to the appropriate publishers. The cost is NOT passed on to the customer/requestor.
